Terms & Conditions

These terms apply to every enquiry and quotation issued by BINM Agro for the supply of fresh produce, IQF frozen vegetables and fruits, and semi-fried frozen potatoes (pommes frites).

1. Quotations

A quotation is issued against a written specification: product, grade, calibre, pack format, inner pack, carton and pallet configuration, and cold chain. Any change to that specification is requoted in writing before production.

2. Prices and Incoterms

Prices are quoted FOB or CIF as stated on the quotation, and are valid for the validity period printed on it. Payment terms, port of loading and destination port are confirmed per buyer.

3. Minimum order quantity and lead time

Minimum order quantity and production lead time depend on the product, grade and pack size. Both are confirmed against the buyer’s specification on the quotation.

4. Product and seasonality

Each product is processed in its own crop window. The crop windows are indicative; the actual specification, harvest and packing dates are confirmed on each order. IQF products are held at −18 °C and can be shipped in any month of the year from cold storage.

5. Documents

Every shipment is issued with a commercial invoice, packing list, bill of lading, certificate of origin, phytosanitary certificate and health certificate, as required for the destination market. Certification documents for the destination market are provided on request with the quotation.

6. Claims

Claims relating to the condition of the goods on arrival must be notified in writing, with photographic evidence, within the period agreed in the contract and while the goods remain in their original sealed packaging and cold chain.

7. Liability

Our liability is limited to the goods supplied under the relevant contract, and the agreed remedy is replacement or credit of the affected quantity, subject to the claim conditions above.
